Dr. Katherine Newman provided an update on two lawsuits aimed at preventing the NIH from reducing the F&A rate to 15%. The first lawsuit was filed by 22 states, including California, while the second was brought by the AAU, ACE, APLU, and 12 other institutions, including the University of California.

Updated F&A Rate Agreement
An updated F&A Rate Agreement reflecting recently approved FY24/25 Composite Benefit Rates (CBRs) has been posted to OCGA’s website. In addition to restating the facilities and administrative cost rates for the period July 1, 2019, through June 30, 2025, it also adds fringe benefit rates for the periods FY21 through FY24.

New DHHS F&A Rate Agreement
The University of California and the U.S. Department of Health and Human Services (DHHS) established a new F&A cost and fringe benefit rate agreement for UCLA. This agreement updates the prior facilities and administrative cost rates and adds fringe benefit rates for FY21 through FY24, applicable to most contract and grant proposals.
